As per Section 7 of the Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of seats in educational institutions and of appointments or posts in the services under the State) Act, 1993 (Tamil Nadu Act 45 of 1994), the Tamil Nadu Backward Classes Commission is to be consulted in the matter of classification and sub-classification of backward classes of citizens for the purpose of the Act.

The Tamil Nadu Act 45 of 1994 has been placed in the Ninth Schedule of the Constitution of India, by the Constitution (76th Amendment) Act, 1994.

In Section 5 of the Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes (Reservation of Seats in Private Educational Institutions) Act, 2006 (Tamil Nadu Act 12 of 2006), similar provision regarding consultation with the Commission has been provided.
